WorkDrivePro Terms of Use
WorkDrivePro terms of use for Spain, France, Germany, Austria, Ireland, Malta and Luxembourg.
1. Owner, contact and scope
WorkDrivePro is a personal project managed by Catalin Tudor Mocanu. Questions about the application can be sent through the authenticated “Contact support” option or to catalinu88@yahoo.com.
This version is offered exclusively in Spain, France, Germany, Austria, Ireland, Malta and Luxembourg to people aged 18 or over. The owner is established in Spain. The interface, essential instructions and public documents are available in Spanish, English, French and German. New multilingual installations start with the “System” option: they use the device language if it is one of the four available languages, or English otherwise. Existing installations retain Spanish or the selected language. The language can be changed in the application settings; a manual choice is retained. Changing the language does not alter the entries made by the user.
Language and territory are separate decisions; nationality and residence are not inferred from the selected language. The territorial scope does not involve geolocation or IP-based blocking and does not limit applicable mandatory rules.
Terms relating to workdays, allowances and kilometres describe personal organisation features. Translation does not automatically adapt their calculations to another country's employment, tax or transport legislation. Amounts are expressed in euros and distances in kilometres unless a feature expressly states otherwise.
The Spanish, English, French and German versions correspond to the same contractual revision, preserve the same rights and obligations and have equal legal effect. No version automatically prevails over another. If an interpretive difference arises, the common meaning that preserves the user's rights and the purpose of the clause will be sought; the difference may be reported to catalinu88@yahoo.com. The application indicates the language of the document presented. Merely changing the interface language does not in itself prompt a new acceptance. If a revision changes the contractual relationship, it will be communicated and the appropriate acceptance will be requested before it applies.
By ticking the relevant box and pressing “Create account”, the user submits their acceptance of these terms. The terms apply when the service accepts the registration and creates the account. The account may require email confirmation before access is allowed. The Privacy Policy is provided as information about data processing: confirming that it has been read does not amount to giving general consent.
2. Service
WorkDrivePro is a personal organisation tool for drivers which, depending on the installed version, allows them to:
- record and view workdays, work periods and shifts;
- enter allowances, items, amounts and summaries;
- save route links and notes;
- record manually entered number plates, kilometre readings and refuelling;
- generate PDF reports; and
- keep data on the device and synchronise it with a personal account.
The application no longer includes a Tachograph section. Records created by earlier versions may be retained and synchronised solely as legacy data to preserve their integrity and allow their erasure; they do not constitute an available feature for creating or viewing records.
Vehicle and Refuelling do not use GPS, request the device's location, read number plates using the camera or obtain vehicle telemetry. The user decides whether to use these features and is responsible for checking the data they enter.
WorkDrivePro is not a certified driving or employment recording system or an official accounting, payroll, tax or transport compliance tool. Nor does it replace records required by an employer, applicable legislation or professional advice. Results depend on the data entered and must be checked before they are used.
3. Free of charge and absence of an economic purpose
The current price is 0 €. There are no in-app purchases, subscriptions, advertising, commercial analytics, marketing or monetisation of personal data.
WorkDrivePro is currently offered as a personal project without an economic or professional purpose on the owner's part. Any introduction of payments, advertising, affiliate arrangements, sponsorship, professional promotion, secondary use of data or a service for businesses will be subject to prior legal and documentary review and will not be activated through a simple unilateral amendment to this text.
The free-of-charge and personal nature of the project describe how it currently operates and do not in themselves exclude the application of consumer protection rules. The owner’s legal status depends on the activity actually carried out, not only on the price or the absence of profit. Where applicable, all statutory rights relating to the supply and conformity of the digital service, its updates and remedies for non-performance remain unaffected, as do statutory withdrawal rights and complaint procedures. No provision of these Terms waives those rights.
4. Account and minimum age
To access and use WorkDrivePro, an account must be created with a profile name or alias, email address and password. There is no guest mode or exclusively local mode of use without an account. The user declares that they are at least 18 years old and undertakes to:
- provide their own name or alias for the profile and a valid email address;
- maintain control of their email address and credentials;
- not share the account or allow unauthorised access;
- protect the device using the measures available; and
- notify us through “Contact support” or at catalinu88@yahoo.com if they detect suspicious access or an incident.
WorkDrivePro may request re-authentication or temporarily restrict access where reasonably necessary to protect the account, investigate an incident or comply with a legal obligation.
5. Permitted use
The application must be used lawfully and with respect for the rights of others. The following are not permitted:
- accessing or attempting to access other people's accounts or data;
- bypassing authentication, separation or security controls;
- deliberately interfering with the integrity or availability of the service;
- introducing malicious code or carrying out abusive automated extraction;
- impersonating another person; or
- using WorkDrivePro to break the law or harm others.
Free-text fields must not be used to store passwords, secrets, special categories of data — such as health, ideology, trade union membership, religion, biometrics or sex life — information about convictions or offences, or data that identifies or could identify other people.
If such data is added by mistake, the user must correct or delete the record as soon as possible. If they cannot do so, they can use “Contact support” or write to catalinu88@yahoo.com, describing the problem without reproducing the affected data in the message. When WorkDrivePro becomes aware that data of this kind has been added, it may restrict access or erase the data to the extent necessary to reduce the risk, respecting applicable legal obligations and providing information where appropriate.
6. User data
The user retains whatever rights they hold over the data and texts they enter. WorkDrivePro processes that information to store, display, synchronise and protect it, generate the requested outputs and provide support, in accordance with the purposes and legal bases described in the Privacy Policy. Acceptance of these terms does not constitute general consent to the processing of personal data.
A company name entered in the profile does not create a relationship between WorkDrivePro and that company or allow the employer to access the account.
The processing of personal data is explained in the Privacy Policy.
7. Local operation and synchronisation
Functional data may initially be stored on the device. With a valid account and session, the application attempts to synchronise it when signing in, when opening WorkDrivePro or bringing it back to the foreground, and when the user requests manual synchronisation. Restoring the connection does not in itself start synchronisation if the application remains in the same state. A pending change may temporarily exist only on the device. Conflicts, an interrupted connection, an unexpected shutdown or an older offline device may delay the update to the remote copy.
Appearance, interface language, text scale, notification preference and other general settings are kept locally and may remain after an account is deleted. The personal dashboard order is also kept locally, associated with the account on that device, and is deleted when its local data is purged. These preferences are not synchronised with Supabase.
The local database does not incorporate WorkDrivePro-specific encryption. Overall security also depends on the device's lock, encryption and condition. Session credentials are stored separately using the operating system's secure storage.
The user must check that important information has been saved correctly. WorkDrivePro must not be used as the sole source of records that must be kept to fulfil a professional or legal obligation.
8. PDFs, routes and external services
PDFs are generated locally in a readable format and may contain personal data. They are not a restore feature and cannot reconstruct the account. Once a file is saved or shared, WorkDrivePro can no longer control or withdraw copies already delivered. The user chooses the initial destination, but the operating system, receiving application, cloud service or recipient may retain or create copies under their own controls and terms.
When a route is opened, WorkDrivePro passes the link to Google Maps or another application selected by the device. WorkDrivePro does not obtain the device's location for this feature. The external service applies its own terms and privacy policy.
Before sharing or opening content, the user must review the destination and the data included.
9. Availability, maintenance and changes
WorkDrivePro is provided without a guaranteed level of availability. There may be interruptions due to maintenance, security fixes, connectivity, changes to operating systems, app stores or external providers. This does not reduce the security and due care obligations legally applicable to the owner.
Features may be corrected or evolve. Only strictly formal or editorial corrections that do not alter the meaning, features, data processing or rights or obligations may be incorporated as such. Any other change will be treated as a modification that is not merely editorial: it will apply prospectively, information will be given before it takes effect, and renewed acceptance or, for a specific purpose, separate consent will be requested where required.
If the project has to close, we will endeavour to give reasonable advance notice and allow data to be exported, unless a security emergency or legal obligation prevents this.
10. Suspension and termination
Access may be suspended proportionately in the event of unlawful use, a security risk, an attempt to access other people's data or a serious breach of these terms. Where possible, the reason will be explained and a means of contact will be offered.
The user may stop using the application or delete their account from the settings. Deletion confirmed by the server ends the usage relationship and deletes the account and associated remote data as explained in the Privacy Policy. On the device from which the operation is performed, it also signs out and clears the local data associated with the account. General application preferences not linked to the account may remain.
Deletion does not automatically withdraw PDF files or JSON copies created by earlier versions and saved outside the app, copies delivered to third parties or local data or sessions on other devices. Those devices require separate action. Uninstalling the application does not, on its own, delete the remote account either.
11. Intellectual property
WorkDrivePro and its proprietary elements are protected by applicable law. A personal, limited, non-exclusive and non-transferable permission is granted to use the application in accordance with these terms.
Licences for third-party components retain their own terms. Nothing in these terms limits uses directly permitted by a free software licence or by law.
12. Liability
Each party is liable in accordance with the law. The user is responsible for the accuracy of the information they enter and for checking calculations, periods and reports before making decisions.
The owner is not liable for acts of applications or recipients selected by the user, incorrectly entered information or losses caused exclusively by failure to protect the device or to keep external records where necessary. This rule does not apply where the damage is attributable to the design, incorrect information, a lack of security or another breach by the owner.
Nothing in these Terms excludes or limits statutory liability for death, personal injury or damage to health, wilful misconduct or gross negligence, or any other rights or liabilities that cannot lawfully be excluded or limited. Nor does it prevent recourse to a competent authority or court.
13. Support and communications
You may submit a written enquiry in Spanish, English, French or German. The owner personally handles support and does not have a native-language support team for each language. Telephone or immediate assistance is not guaranteed. Essential instructions and responses concerning security, accounts or rights will be provided in an understandable form. These support limitations do not reduce any applicable rights or statutory time limits.
Selecting a language does not in itself send your notes, reports or enquiries to a translation service. Introducing a translation provider that processes personal data will require an assessment and a prior update to the relevant information.
A signed-in user may submit an enquiry through “Contact support”. The form uses the account's email address and allows an alias, category, subject and message to be entered as applicable. When the service confirms submission, it saves the enquiry in the private support inbox and displays a reference in the application. Access to that inbox is restricted to authorised administrator accounts, which may filter enquiries by category and status and update their handling status. No automatic acknowledgement is sent to the account's email address. If more information is needed, a reply may subsequently be sent to that address. You may also write directly to catalinu88@yahoo.com, which is the support mailbox and reply address.
The confirmation and reference displayed in the application establish that the enquiry has been registered for handling, not that it has been resolved or that there is a response deadline. Passwords, access codes, complete exports, identity documents and particularly sensitive information must not be sent. If documentation needs to be exchanged, an appropriate channel will be agreed first.
Operational account communications — for example, email confirmation or access recovery — are not advertising. Supabase Auth manages authentication links and Resend delivers those emails and the auxiliary support notification to the owner's mailbox. The enquiry submitted through the form is registered in the private inbox; email does not replace that record.
14. Applicable law
These terms are governed by Spanish law. This choice does not deprive the user of the mandatory provisions afforded by the law of their country of habitual residence where applicable, including the consumer protection rules in Article 6 of Regulation (EC) 593/2008.
Where the legal requirements for a consumer relationship are met in a particular case, the consumer retains the jurisdictional rights afforded by Regulation (EU) 1215/2012, including, where applicable, the ability to bring a claim before the courts of their domicile. Proceedings against a consumer may only be brought before the courts determined by that legislation. These terms do not impose exclusive Spanish jurisdiction or limit other mandatory jurisdictional rights.
15. Changes to these terms
The version and update date appear at the beginning. Only strictly formal or editorial corrections that do not alter the meaning, features, data processing or rights or obligations may be published without the procedure provided for other changes. Every other modification will be communicated before it takes effect and will require renewed acceptance where it changes the usage relationship or the law requires it.
